The Labor and Medical Law Services Team of Yunnan Zhongji Law Firm is composed of experienced experts in labor law and healthcare, as well as seasoned professional lawyers who possess both extensive practical experience and a solid theoretical foundation. The head of the department previously held a senior HR position at a large state-owned enterprise.

With over ten years of professional experience in the resources sector, our team’s core lawyers all boast extensive practical experience in labor law and healthcare law. We have witnessed the establishment of the comprehensive employment contract system in 1995 from its very inception and participated in the transition of pension insurance from industry-based pooling to socialized management.

Throughout the entire management process, including the initial social pooling of medical insurance and the earliest implementation of work-related injury insurance for migrant workers, I have a thorough grasp of the historical evolution of labor law and social insurance law, as well as related policies, regulations, and legal frameworks. I am adept at handling issues concerning enterprise personnel, wages, and insurance.

We have a strong theoretical foundation and extensive practical experience in areas such as welfare and labor law, as well as in the establishment and operation of medical institutions, the prevention of medical legal risks, and the resolution of doctor-patient disputes.

This specialized team has handled nearly a thousand cases involving labor and social security as well as healthcare, including disputes over employee departures, disputes over retirement benefits and deemed contribution years, disputes over work-related injury recognition and compensation, and the establishment and improvement of legal risk prevention and control systems for medical institutions.

(1) Legal Services in Human Resource Management

· Review of employment contracts between employers and individuals, as well as guidance on contract signing;

· The employer has a well-established human resources management system (including, but not limited to, drafting, reviewing, and revising the employee handbook, designing schemes and regulations for the protection of trade secrets and non-compete restrictions);

· Develop and implement plans for adjusting labor relations in corporate mergers, spin-offs, dissolutions, and bankruptcies.

(2) Social Insurance Legal Services

· Provide handling procedures for employee deaths and injuries sustained in the course of official duties, as well as procedures for handling cases involving illness, non-work-related injuries, and non-work-related deaths;

· Collaboratively design and implement the corporate pension plan.

(3) Labor arbitration and litigation services

· Accepting mandates to represent clients in arbitration and litigation matters.

(4) Legal services provided to medical institutions.

· Prevention and management of medical disputes;

· Coordinating the handling of medical-patient disputes, and acting as agent in arbitration and litigation proceedings involving medical injury compensation disputes, medical service contract disputes, and other related disputes;

· Provide legal training to medical institutions to enhance healthcare professionals’ awareness of the rule of law.

· Build harmonious healthcare relationships and assist medical institutions in carrying out administrative and personnel reforms.

(5) Legal services provided to the patient side

· Provide basic legal advice to the patient side;

· Assist the patient’s side in carrying out preliminary preparations such as photocopying and sealing medical records, and guide the patient’s side in collecting and preserving relevant evidence.

· Draft relevant legal documents for the patient side;

· Represent the patient’s side in negotiations and consultations with medical institutions to secure their legitimate rights and interests;

· Representing the patient’s side in initiating and participating in technical appraisals or judicial appraisals of medical malpractice;

· Representing the patient’s side in filing lawsuits, appealing cases, and participating in litigation;

· File an application for compulsory enforcement on behalf of the patient.
